Buyer of the Signage hereby expressly acknowledges and agrees by purchasing the Signage that Florida Agritourism Association and its affiliates, officers, or employees shall not be liable for any damages, or any other loss, whether direct, indirect, consequential, incidental, or special which Buyer or any future or subsequent user of the Signage may suffer, arising from any defect, effort, fault, use, or misuse of the Signage. IN NO EVENT SHALL BUYER HOLD FLORIDA AGRITOURISM ASSOCIATION LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR CONNECTED WITH THE USE OR MISUSE OF ITS PRODUCTS.
Florida Agritourism Association makes no warranty whatsoever with respect to the Signage, including any: (a) warranty of merchantability or (b) warranty of fitness for a particular purpose. THE BUYER OR ANY FUTURE OR SUBSEQUENT USER, AND NOT FLORIDA AGRITOURISM ASSOCIATION, IS SOLELY AND ENTIRELY RESPONSIBLE FOR USING THE SIGNAGE IN COMPLIANCE WITH SECTION 570.89, FLORIDA STATUTES, AND ALL OTHER APPLICABLE LAWS AND REGULATIONS GOVERNING AGRITOURISM ACTIVITIES. USER BEARS SOLE RESPONSIBILITY FOR LOCATION PLACEMENT AND NUMBER OF SIGNS PLACED.
